Defendants having moved for an extension of time to perfect their appeals taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on October 10, 2013, and
Plaintiff having moved for an extension of time to perfect its cross appeal taken from the order entered October 10, 2013,
Now, upon reading and filing the affidavit of James I. Myers, Esq., sworn to June 3, 2014, the affidavit of David V. Jaworski, Esq., sworn to June 3, 2014, the affidavit of Craig R. Bucki, Esq., sworn to June 6, 2014, and the notices of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that defendants' motions are granted, and defendants shall perfect their appeals on or before September 29, 2014, and, in the event of failure to so perfect, the appeals are hereby dismissed without further order, and
It is further ORDERED that plaintiff's motion is granted, and plaintiff shall perfect its cross appeal on or before November 3, 2014, and, in the event of failure to so perfect, the cross appeal is hereby dismissed without further order.
