DECISION & ORDER ON MOTION

Motion by petitioner for leave to reargue a proceeding, inter alia, in effect, pursuant to CPLR article 78 in the nature of mandamus, to compel the respondent Albert Tomei, a Justice of the Supreme Court, Kings County, to vacate an order of that court entered October 16, 2013, in a criminal action entitled People v Kelly, commenced in that court under Indictment No. 545/11, which was determined by decision and judgment of this Court dated April 23, 2014.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied
