DECISION & ORDER ON MOTION

Motion by Craig Schlossberg for leave to appeal to this Court from stated portions of an order of the Supreme Court, Suffolk County, dated April 15, 2014, and, in effect, to stay certain construction at the subject premises, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
