Now, upon reading and filing the affirmation of Gerard A. Strauss, Esq., dated May 20, 2014, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as it seeks to have the appeal treated as a valid appeal from the judgment (see CPLR 5520 (c); Kerner v Kerner, 262 AD2d 1082), and

It is further ORDERED that the motion is otherwise denied.
