DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, to dismiss an appeal from an order of the Supreme Court, Nassau County, dated December 16, 2013, or to direct the appellant to serve him with a copy of the unredacted appendix and brief. Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to direct the appellant to serve the respondent with a copy of the appellant's unredacted appendix and brief is granted, and on or before July 24, 2014, the appellant shall serve the respondent's counsel with an unredacted copy of the appellant's appendix and brief; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the application is granted, the respondent's time to serve and file a brief on the appeal is enlarged until August 25, 2014, and the respondent's brief must be served and filed on or before that date.
