DECISION & ORDER ON MOTION

Motion by Sharon Kroeger to deem her notice of appeal from an order and judgment (one paper) of the Supreme Court, Dutchess County, dated December 11, 2013, also to be on behalf of the petitioners Ten Towns to Preserve Main Street, Housatonic Environmental Action League, and Anne Veteran. Application by Sharon Kroeger pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that the application is granted, Sharon Kroeger's time to perfect her appeal is enlarged until August 18, 2014, and the record or appendix on the appeal and Sharon Kroeger's brief must be served and filed on or before that date.
