| DECISION & ORDER ON MOTION |
Separate motions by the respondents Planning Board of Town of Ramapo, Town Board of Town of Ramapo, and Town of Ramapo and the respondent Scenic Development, LLC, to dismiss an appeal from a judgment of the Supreme Court, Rockland County, dated September 10, 2012, on the ground that the appellants' appendix is inadequate and contains matter dehors the record, and the brief does not comply with the rules of the Court.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are denied on condition that on or before August 21, 2014, the appellants remove from the copies of the brief filed with the Clerk of the Court the Regulatory Guidance Letter of the US Army Corps of Engineers, dated June 26, 2008, and attachments to the Letter; and it is further,
ORDERED that on the Court's own motion, the respondents' time to serve and file their respective briefs is enlarged until September 4, 2014, and the respondents' briefs, if any, must be served and filed on or before that date.
