DECISION & ORDER ON MOTION

Motion by the appellants on an appeal from an order of the Supreme Court, Suffolk County, dated December 18, 2013, for leave to amend the Request for Appellate Division Intervention to include the information for the attorney representing the defendant Joe Guzman, and to enlarge the time to serve the timely-filed notice of appeal on the defendant Joe Guzman. Application by the appellants pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to amend the Request for Appellate Division Intervention to include the information for the attorney representing the defendant Joe Guzman is granted, and the Request for Appellate Division Intervention is deemed amended to include that information; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve the notice of appeal on the defendant Joe Guzman is granted, and the notice of appeal, is deemed timely served (see CPLR 5520[a]); and it is further,

ORDERED that the application is granted, the appellants' time to perfect the appeal is enlarged until August 18, 2014, and the record or appendix on the appeal and the appellants' brief must be served and filed on or before that date.
