| DECISION & ORDER ON MOTION |
Motion by the respondent-respondent on an appeal from an order of the Family Court, Kings County, dated May 12, 2014, to vacate a decision and order on motion of this Court dated May 29, 2014, which stayed all proceedings in the above-entitled matters to the extent that it precludes the Family Court from determining a motion to relieve assigned counsel and to assign new counsel for the respondent, and, in effect, to dismiss the appeal as academic.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to vacate the decision and order on motion of this Court dated May 29, 2014, which stayed all proceedings in the above-entitled matters to the extent that it precludes the Family Court from determining a motion to relieve assigned counsel and to assign new counsel is granted; and it is further,
ORDERED that the branch of the motion which is, in effect, to dismiss the appeal as academic is denied with leave to renew once new counsel is assigned.
