| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Family Court, Queens County, dated July 15, 2014, pending hearing and determination of an appeal therefrom, for an expedited briefing schedule, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order is denied; and it is further,
ORDERED that the branch of the motion which is for an expedited briefing schedule is granted to the extent that the appeal shall be actively managed and the Clerk of the Court shall issue a scheduling order pursuant to 22 NYCRR 670.4(a), and this branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see CPLR 5521[b]; Family Ct Act § 1112).
