Motion by the appellant, inter alia, to strike the brief filed by Gambar Food Corp. on an appeal from an order of the Supreme Court, Suffolk County, dated June 12, 2013, on the ground that it is not a party to the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike the brief filed by Gambar Food Corp. is granted, and the brief is stricken; and it is further,
