Appellant having moved for an extension of time to file and serve a pro se supplemental brief on the appeal taken from an order of the Erie County Court, dated December 11, 2012,
Now upon reading and filing the statements of Odell Wilkins filed on July 23, 2014 and July 28, 2014, the notice of motion with proof of service thereof, the statement of Donna A. Milling, Esq. dated July 29, 2014, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on the condition that appellant provides to the Clerk's Office proof of service of the affidavit of Odell Wilkins sworn on July 19, 2014 upon assigned counsel and the People by September 2, 2014, and upon such receipt of proof of service, the Clerk is directed to accept the copies of the affidavit sworn to July 19, 2014, submitted to this Court on July 28, 2014 for filing and said documentation will be deemed a pro se supplemental brief, and
It is further ORDERED that respondent shall file a brief in response to the pro se supplemental brief, if any, on or before October 2, 2014.
