DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Supreme Court, Suffolk County, dated July 25, 2014, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and enforcement of the order is stayed pending hearing and determination of the appeal on condition that the record or appellant's appendix and the appellant's brief is served, as set forth below, and filed on or before September 5, 2014; and it is further,

ORDERED that in the event the appeal is not served, as set forth below, and filed on or before September 5, 2014, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice; and it is further,

ORDERED that the respondent shall serve, as set forth below, and file a brief, if any, and appendix, if applicable, on or before September 19, 2014; and it is further,

ORDERED that the appellant shall serve, as set forth below, and file a reply brief, if any, on or before September 29, 2014; and it is further,

ORDERED that service of all briefs and the record on appeal or the parties' appendices, if applicable, shall be effected pursuant to CPLR 2103(b)(1), (3), or (6).
