DECISION & ORDER ON MOTION

Motion by appellants for leave to reargue and renew their prior motion for a stay pending the determination of an appeal from an order of the District Court of Suffolk County, Third District, dated February 3, 2014, which motion was determined by decision and order on motion of this court dated May 16, 2014.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and, upon reargument and renewal, this court's decision and order on motion dated May 16, 2014 is recalled and vacated, and appellants' motion for a stay pending the determination of the appeal is granted on condition that the appeal be perfected by October 2, 2014; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
