Motion by respondent on an appeal from an order of the Civil Court of the City of New York, Kings County, entered October 25, 2012, for the release to it of the funds on deposit. Cross motion by appellant for the release to her of the funds on deposit.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that respondent's motion is granted and the New York City Department of Finance is directed to release the funds on deposit in this matter to respondent K.T.N. Holding, LLC, less any lawful fees; and it is further,
ORDERED that appellant's cross motion is denied.
