| ORDER ON APPLICATION |
Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Suffolk County, dated May 23, 2014, and for leave to prosecute the appeal as a poor person and for the assignment of counsel.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the branch of the application which is to enlarge the time to perfect the appeal is denied as premature as the time to perfect the appeal does not expire until December 13, 2014; and it is further,
ORDERED that the application is otherwise denied without prejudice to making a formal motion on notice for the relief sought.
