Motion for reargument, to conjoin, for extension of time to perfect appeal, to assign counsel to assemble record and for further relief.

Motion for permission to proceed as a poor person and for assignment of counsel.

Upon the papers filed in support of the motions, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for reargument, to conjoin, to assign counsel to assemble records and for further relief is denied, and it is further

ORDERED that the motion for an extension of time to perfect the appeal is granted, and the time is extended to October 20, 2014, and it is further

ORDERED that the motion for permission to proceed as a poor person and for assignment of counsel is granted, to the extent that defendant's poor person status is continued, and the appeal shall be perfected in accordance with section 800.14 of this Court's Rules of Practice, and it is further

ORDERED that Bruce Evans Knoll, Esq., P.O. Box 2072, Empire State Plaza Station, Albany, New York, 12220 is assigned to represent defendant upon the appeal pursuant to County Law § 722, and it is further

ORDERED that pursuant to section 800.4 (c) of this Court's Rules of Practice, the Greene County Clerk shall furnish to appellate counsel one copy of the transcripts of the stenographic minutes of all proceedings in this matter and one copy of any other paper or document on file in that office which is material and relevant to this appeal, except those portions which appellate counsel or the criminal court determines are unnecessary for perfection of the appeal, and to forward forthwith the other copy of said transcripts to the Clerk of this Court. However, if such minutes and other papers or documents were previously provided to defendant, Scott Myers, said defendant shall forward those documents to Bruce Evans Knoll, Esq., on or before September 22, 2014.
