2014-06253 In the Matter of Patricia Ruane, respondent, v John Patrick Ruane, Sr., appellant. (Docket No. F-1720-07/07B/08C/10D/11E)
| DECISION & ORDER ON MOTION |
Motion by Rosa P. Tragni, counsel assigned to represent the respondent by the Family Court, Queens County, to be relieved on an appeal from an order of the Family Court, Queens County, dated May 12, 2014, and for the assignment of new counsel to represent the respondent.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and leave to appeal has not been granted; and it is further,
ORDERED that the motion is denied as academic.
ENG, P.J., MASTRO, SGROI and BARROS, JJ., concur.
