Motion by the appellant to strike the respondent's brief on an appeal from a judgment of the County Court, Westchester County, rendered May 21, 2012, on the ground that it responds to the appellant's original brief which was stricken by decision and order on motion of this Court dated October 29, 2013.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the brief filed by the respondent is stricken, and the respondent may serve and file a replacement brief on or before October 5, 2014.
