Application by the respondent Mark Peltz pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from a decree of the Surrogate's Court, Nassau County, dated December 4, 2012.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is granted to the extent that the applicant's time to serve and file a brief is enlarged until October 16, 2014, the applicant's brief must be served and filed on or before that date, and the application is otherwise denied.
