| DECISION & ORDER ON MOTION |
Motion by the defendant for leave to appeal to the Court of Appeals from a decision and order on application of a Justice of this Court dated June 10, 2014, which denied his application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the Supreme Court, Queens County, dated July 16, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as no appeal lies to the Court of Appeals from the decision and order on application dated June 10, 2014 (see CPL 450.70, 450.90).
