V

HONORABLE JOHN H. CRANDALL, HERKIMER COUNTY COURT

AND HERKIMER SURROGATE COURT JUDGE.

Petitioner having moved by order to show cause for permission to commence this CPLR article 78 proceeding as a poor person, having moved for summary judgment, and having moved for other relief,

Now, upon reading and filing the affidavits of Gregory Harvey sworn to July 8, 2014, the proposed order to show cause, the verified petition sworn to July 8, 2014, all supporting papers submitted therewith, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motions are denied on the ground that the facts set forth by petitioner fail to demonstrate merit to the proceeding.
