DECISION & ORDER ON MOTION

Motion by the appellant to strike stated portions of the respondent's brief on appeals from two orders of the Family Court, Kings County, dated June 25, 2013, and August 29, 2013, respectively, on the ground that they refer to matter dehors the record. Cross motion by the respondent to dismiss the appeals on the ground that the appellant is a fugitive and can no longer obey the mandate of the Court.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion and the cross motion are held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof.
