Appellant having moved to vacate the dismissal of the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on May 10, 2012 (docket No. CA 14-01397), and January 22, 2013 (docket No. CA 14-1398),
Now, upon reading and filing the affirmation of Peter M. Hartnett, Esq., dated July 25, 2014, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal taken from the order entered May 10, 2012, is denied, and
It is further ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal taken from the order entered January 22, 2013, is granted on the condition that appellant perfects the appeal on or before November 17, 2014.
Memorandum: Appellant's motion insofar as it seeks to vacate dismissal of the appeal taken from the order entered May 10, 2012, is untimely (see 22 NYCRR 1000.13 [g]).
