Chei Fong Lee, appellant,

v Lin Cui Zhu, respondent.

(Index No. 365/11)

DECISION & ORDER ON MOTION

Application by the appellant for leave to make a fourth motion, inter alia, to reinstate an appeal from an order of the Supreme Court, Queens County, dated June 5, 2012, which was dismissed by decision and order on motion of this Court dated May 8, 2013, for failure to timely perfect. After the appeal was dismissed, the appellant made three motions, inter alia, to reinstate the appeal. The motions were denied by decisions and orders on motion of this Court dated July 12, 2013, October 2, 2013, and December 11, 2013, respectively. The decision and order on motion dated December 11, 2013, also precluded the appellant from making further motions without prior leave of this Court. Thereafter, prior to the instant application, the appellant made three applications for leave to make a fourth motion, inter alia, to reinstate the appeal, each of which has been denied.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is denied; and it is further,

ORDERED that on the Court's own motion, the appellant is enjoined from making any further motions or applications in connection with the above-entitled appeal.

SKELOS, J.P., DICKERSON, MALTESE and LASALLE, JJ., concur.
