Motion by the appellant to vacate an order of this court dated June 10, 2013, which dismissed an appeal from a judgment of the District Court of Nassau County, Second District entered February 16, 2011, and, in effect, to enlarge the time to perfect the appeal. Separate motion by respondent to submit late opposition to the motion to vacate.
Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is
ORDERED that the motions are consolidated for purposes of disposition; and it is further,
ORDERED that the motion by appellant to vacate the order dismissing the appeal is denied; and it is further,
ORDERED that the motion by respondent to submit late opposition is denied as moot.
