DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Kings County, rendered June 16, 2009, in effect, to direct the respondent to file the papers filed in the Supreme Court in connection with the respondent's motion to resettle the trial transcript, including the transcripts of the proceedings held in connection with the motion, and the order that determined that motion.

Upon the papers filed in support of the moton and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and on or before October 24, 2014, the respondent shall file the papers filed in the Supreme Court in connection with the respondent's motion to resettle the trial transcript, including the transcripts of the proceedings held in connection with the motion, and the order that determined that motion; and it is further,

ORDERED that the appellant may serve and file a replacement brief on or before November 24, 2014, if he be so advised; and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until December 24, 2014, and the respondent's brief must be served and filed on or before that date.
