Defendants having separately moved for an extension of time to perfect their appeals taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on October 10, 2013, and
Plaintiff having moved for an extension of time to perfect its cross appeal and to consolidate the defendants' appeals with plaintiff's cross appeal taken from the order entered October 10, 2013,
Now, upon reading and filing the affidavit of James I. Myers, Esq., sworn to September 11, 2014, the affidavit of David V. Jaworski, Esq., sworn to September 15, 2014, the affidavit of Craig R. Bucki, Esq., sworn to September 19, 2014, and the notices of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that defendants' motions are granted to the extent that the first ordering paragraph of the order of this Court entered June 24, 2014, is hereby amended by deleting the date September 29, 2014, and inserting in its place the date December 8, 2014, and
It is further ORDERED that plaintiff's motion insofar as it seeks an extension of time to perfect its appeal is granted to the extent that the second ordering paragraph of the order Court entered June 24, 2014, is hereby amended by deleting the date November 3, 2014, and inserting in its place the date January 12, 2015, and
It is further ORDERED that plaintiff's motion insofar as it seeks to consolidate the appeals from the order entered October 10, 2013, is granted.
