DECISION & ORDER ON MOTION

Motion by appellant Elizabeth Light for a stay pending the determination of an appeal from a judgment of the Justice Court of the Town of Carmel, Putnam County, entered September 30, 2013, for leave to prosecute the appeal by the appendix method, and, in effect, for summary reversal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking leave to prosecute the appeal by the appendix method is denied as unnecessary, as the record has been received; and it is further,
ORDERED that the branch of the motion seeking, in effect, summary reversal is denied; and it is further,
ORDERED that the branch of the motion seeking a stay pending the determination of the appeal is granted on condition that the appeal be perfected by November 7, 2014, and on the further condition that within 10 days of the date of this decision and order on motion appellant deposit with the court below the sum of $11,320 less any amounts previously garnished from appellant Elizabeth Light's wages; and it is further,
ORDERED that in the event that any the above conditions are not met, the court, on its own motion, may vacate the stay, or respondents may move to vacate the stay on three days' notice.
