DECISION & ORDER ON MOTION

Motion by Melvin Quinones and Camila Quinones for leave to appeal to this Court from an order of the Family Court, Kings County, dated September 16, 2014, to stay enforcement of the order and direct that the subject children shall reside with the mother from Sunday at 6:00 P.M. until Friday at 6:00 P.M., and the father from Friday at 6:00 P.M. until Sunday at 6:00 P.M. each week, and Melvin shall attend PS 294 and Camila shall attend pre-school in the Bronx, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the moving papers are deemed to constitute a timely notice of appeal; and it is further,

ORDERED that enforcement of the order dated September 16, 2014, is stayed and the subject children shall reside with the mother from Sunday at 6:00 P.M. until Friday at 6:00 P.M., and shall reside with the father from Friday at 6:00 P.M. until Sunday at 6:00 P.M., each week, and the child Melvin shall attend PS 294 and the child Camila shall attend pre-school in the Bronx, either pending hearing and determination of the appeal or further order of the Family Court, Kings County, whichever occurs first.
