Sendowski, Janusz v Pilzer, Suzanne
It is Ordered that tenant-appellant's motion is granted to the extent of continuing the stay of the final judgment and warrant of eviction and all proceedings in Civil Court, on condition that respondent-appellant: 1-perfects her appeal by no later than the February 2015 term - the filing deadline is December 9, 2014, and 2- pays landlord accruing use and occupancy in the amount reserved in the most recent lease agreement on or before each subsequent rental due date, without prejudice. Respondent-appellant is directed to this Court's September 29,2014 order which granted her motion for poor person relief. No further enlargements of time will be granted. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days' notice, for an order vacating the stay and dismissing the appeal.
