| DECISION & ORDER ON MOTION ts; |
Motion by the plaintiffs-respondents-appellants on an appeal and cross appeals from a judgment of the Supreme Court, Queens County, entered March 10, 2014, to dismiss the appeal on the ground that the joint record is inadequate, or, in the alternative, to enlarge the time to serve and file a brief. Separate motion by the third-party defendants-respondents-appellants to dismiss the appeal on the ground that the joint record is inadequate, or, in the alternative, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branches of the motions which are to dismiss the appeal on the ground that the joint record is inadequate is denied without prejudice to raising the issue that the joint record is inadequate to determine certain issues raised by the defendants third-party plaintiffs-appellants-respondents in their briefs; and it is further,
ORDERED that the branches of the motions which are to enlarge the time to serve and file a brief are granted, the respondents-appellants' time to serve and file their respective briefs is enlarged until November 20, 2014, and the respondents-appellants' briefs, including the points of argument on the cross appeals (see 22 NYCRR 670.8[c][3]), must be served and filed on or before that date.
BALKIN, J.P., LEVENTHAL, MALTESE and BARROS, JJ., concur.
