DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, to dismiss an appeal from an order of the Supreme Court, Nassau County, dated March 7, 2013, to strike portions of the appellant's brief and, in effect, to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is to strike portions of the appellant's brief is granted to the extent that on or before November 5, 2014, the appellant shall correct the citations on page 22 of the copies of the appellant's brief filed with the Clerk of the Court to reflect proper citations to the appellant's appendix, and that branch of the motion is otherwise denied; and it is further,

ORDERED that the branch of the motion which is, in effect, to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until December 5, 2014, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
