DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated January 27, 2014, for poor person relief and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branches of the motion which are for leave to prosecute the appeal on the original papers and to waive the filing fee are denied as unnecessary as the appeal was perfected on the appendix method and the filing fee was paid; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that on the Court's own motion, the appellant's time to serve and file a brief is enlarged until November 24, 2014, and the appellant's brief must be served and filed on or before that date.
