| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue an appeal from a judgment of the Supreme Court, Nassau County, entered January 4, 2013, which was determined by decision and order of this Court dated June 18, 2014, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Cross motion by the respondent, inter alia, to strike the appellant's motion, to direct the appellant to comply with the judgment, and for an award of costs and an attorney's fee.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the branches of the cross motion which are to strike the appellant's motion, and for an award of costs and an attorney's fee are denied; and it is further,
ORDERED that the cross motion is otherwise denied without prejudice to seeking relief in the Supreme Court, Nassau County.
