DECISION & ORDER ON MOTION

Motion by the appellant on appeals from two judgments of the Supreme Court, Kings County, rendered March 29, 2007, and December 8, 2010, respectively, and, by permission, from an order of the same court, dated September 12, 2011, to be furnished with the transcript of certain proceedings which occurred on April 27, 2010.

Upon the papers filed in support of the motion, and the papers filed in relation thereto, it is

ORDERED that the motion is granted, and the decisions and orders on motion of this Court dated May 29, 2009, March 21, 2011, and August 13, 2012, respectively, which granted poor person relief to the appellant are amended to include a direction to the court reporter to make, certify and file two transcripts of the stenographic minutes of the proceedings which occurred on April 27, 2010, if they are available, except for those minutes already transcribed; and it is further,

ORDERED that the stenographer is directed to make, certify and file such minutes within 45 days of the date of this decision and order on motion, and the clerk of the trial court is directed to furnish one copy to the appellant's counsel, without charge (see CPL 460.70); assigned counsel is directed to turn over the transcript to the respondent when counsel serves a brief upon the respondent; and it is further,

ORDERED that the appellant's assigned counsel is directed to serve a copy of this order upon the Clerk of the court from which the appeals are taken
