DECISION & ORDER ON MOTION

By order on certification of this Court dated December 12, 2013, on an appeal from an order of the Family Court, Suffolk County, dated September 13, 2013, the following named attorney was assigned to prosecute the appeal:

Now, on the Court's own motion, it is

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as new counsel to prosecute the appeal:

and it is further,

ORDERED that on or before November 24, 2014, assigned counsel must advise the Court, in writing, whether (1) she adopts the brief filed by former assigned counsel, (2) she adopts the brief filed by former assigned counsel and will serve and file a supplemental brief, or (3) she will serve and file a replacement brief; and it is further,

ORDERED that in the event assigned counsel adopts the brief filed by former assigned counsel, in which an issue concerning the constitutionality of Family Court Act § 1039-b is raised, assigned counsel shall, on or before November 24, 2014, serve a copy of the brief on the Attorney General, as required by CPLR 1012(b) and Executive Law § 71, along with a copy of this decision and order on motion, and shall file proof of such service with this Court; and it is further,

ORDERED that within 10 days of service upon him of a copy of the brief, the Attorney General shall notify this Court in writing whether he intends to intervene on this appeal.
