It is Ordered that plaintiff-respondent's motion is granted without opposition, only to the extent of dismissing the appeal. That portion of respondent's motion that seeks the release of funds is denied without prejudice to respondent renewing said motion and presenting proof that defendant-appellant did, in fact, deposit monies with the Finance Administrator of the City of New York in connection with this case.
