It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that plaintiff-appellant's cross motion is granted to the extent of ordering plaintiff-appellant to settle the transcript of the traverse hearing held below as part of the record on appeal, and then serve and file the corrected record on appeal on or before December 9, 2014.
