Appellant having moved for a stay of enforcement of the judgment of the Supreme Court entered in the Office of the Clerk of the County of Monroe on May 6, 2013 (docket No. CA 14-01654), pending the hearing and determination of the appeal taken herein, and for other relief,
Now, upon reading and filing the affirmation of Charles W. Rogers, Esq., dated September 9, 2014, the notice of motion with proof of service thereof, the affidavit of Christina Borrelli sworn to September 17, 2014, and the affirmation of Nigos Karatas, Esq., dated September 17, 2014, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks a stay of enforcement of the judgment is dismissed on the ground that the appeal from the judgment was previously dismissed pursuant to this Court's rules (see 22 NYCRR 1000.12 [b]), and
It is further ORDERED that the motion insofar as it seeks a stay of enforcement of the order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on June 3, 2014 (docket No. CA 14-01934), is denied.
