DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, dated June 4, 2014, to amend a decision and order on motion of this Court dated August 12, 2014, which, inter alia, stayed Arthur E. from selling any of the appellant's assets, by adding certain language to the decretal paragraph thereof.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and the decision and order on motion of this Court dated August 12, 2014, is amended by adding to the decretal paragraph, after the word "broker" and before the comma preceding the word "pending", the following language: " except that Arthur E. may pay necessary expenses to preserve the appellant's assets and make distributions as permitted under the Supplemental Needs Trust dated December 12, 2012, to meet the appellant's personal needs, to the extent that such distributions will not impair or diminish the receipt or eligibility of government benefits or assistance."
