Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Nassau County, dated September 15, 2006, on the ground that no appeal lies from a judgment entered upon the default of the appealing party.

ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements (see CPLR 5511).
