| DECISION & ORDER ON MOTION |
Motion by the nonparty-appellant, in effect, to deem service of the record and brief upon Sanders, Sanders, Block, Woycik, Viener & Grossman, P.C., the attorneys for the plaintiff, to be adequate service upon the third-party defendants on an appeal from an order of the Supreme Court, Nassau County, dated October 31, 2013, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to deem service of the record and brief upon Sanders, Sanders, Block, Woycik, Viener & Grossman, P.C., to be adequate service upon the third-party defendants is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the nonparty-appellant's time to perfect the appeal is enlarged until December 1, 2014, and the record or appendix and the nonparty-appellant's brief shall be filed on or before that date, and served upon Sanders, Sanders, Block, Woycik, Viener & Grossman, P.C. the attorneys of the plaintiff and upon Melvin Tanenbaun, the attorney for the third-party defendants, on or before December 1, 2014.
