| DECISION & ORDER ON MOTION |
Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Kings County, dated January 30, 2012, as untimely taken. By decision and order on motion of this Court dated November 8, 2012, the matter was remitted to the Supreme Court, Kings County, to hear and report on the issue of whether the order dated January 30, 2012, was served upon the appellant's counsel with notice of entry and, if so, when service was effected, and the motion was held in abeyance in the interim. The Supreme Court, Kings County, has filed its report dated May 16, 2014.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the report of the Supreme Court, Kings County, dated May 16, 2014, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the appellant's time to perfect the appeal is enlarged until January 2, 2015, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
