DECISION & ORDER ON MOTION

Motion by the respondent-appellant to stay enforcement of an order of the Family Court, Kings County, dated November 3, 2014, and to release the subject child to her care and custody, pending hearing and determination of an appeal from the order, and for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of the order and to release the subject child to the respondent-appellant's care and custody is granted, enforcement of the order is stayed, and the subject child is released to the respondent-appellant's care and custody, under the supervision of the petitioner-respondent, pending hearing and determination of the appeal; and it is further,

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see Family Ct Act § 1112[a]).
