Appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on August 23, 2013 (docket No. CA 14-01101), and August 29, 2013 (docket No. CA 14-01102),
Now, upon reading and filing the affidavit of Mark E. Lewis, Esq., sworn to November 10, 2014, the notice of motion with proof of service thereof, and the affidavit of Ann F. Arnold, Esq., sworn to November 13, 2014, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal from the order entered August 23, 2013, is granted to the extent that the ordering paragraph of the order of this Court entered September 12, 2014, is hereby amended by deleting the date November 12, 2014, and inserting in its place the date January 13, 2015, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal from the order entered August 29, 2013, is dismissed without prejudice to a motion to vacate dismissal of the appeal (see 22 NYCRR 1000.13 [g]).
Memorandum: No further extensions of time to perfect the appeal from the order entered August 23, 2013, will be granted.
