| DECISION & ORDER ON MOTION |
Motion by the petitioner-respondent on an appeal from a judgment of the Supreme Court, Suffolk County, dated May 6, 2014, inter alia, to stay the appellant from collecting or attempting to collect the sum of $256,853.99 from the petitioner-respondent, calculated by the appellant as interest owed by the petitioner-respondent in the appellant's determination dated April 20, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay the appellant from collecting or attempting to collect the sum of $256,853.99 from the petitioner-respondent, calculated by the appellant as interest owed by the petitioner-respondent in the appellant's determination dated April 20, 2012, is granted, and the appellant is stayed from collecting or attempting to collect the sum of $256,853.99 calculated by the appellant as interest owed by the petitioner-respondent in the appellant's determination dated April 20, 2012, pending hearing and determination of the appeal; and it is further,
ORDERED that in the motion is otherwise denied.
