2013-10956 Nicholas Cicero, Jr., et al., respondents, v Nicholas Cicero, Sr., et al., appellants. (Index No. 101498/09)
| DECISION & ORDER ON MOTION |
Appeal by Nicholas Cicero, Sr., Joan A. Cicero, and 1650 Forest Avenue Corporation from an order of the Supreme Court, Richmond County, dated September 5, 2013. By decision and order on motion of this Court dated October 22, 2014, the appellants were directed, on or before November 19, 2014, to serve and file a supplemental appendix containing those portions of the transcripts necessary for the Court to fully consider the issues to be raised by the appellants and the respondents. The appellants have not served and filed a supplemental appendix.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated October 22, 2014.
BALKIN, J.P., CHAMBERS, HALL and COHEN, JJ., concur.
