DECISION & ORDER ON MOTION

Motion by Geoffrey E. Chanin, counsel assigned to prosecute an appeal from a judgment of the County Court, Orange County, rendered December 12, 2013, to be relieved on the ground that the appellant has abandoned the appeal by failing to respond to telephone and written communications made to him by assigned counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied with leave to renew upon proper papers, including proof of service on the appellant at his last known address.
