On the court's own motion, it is
ORDERED that this court's order dated December 3, 2012, withdrawing an appeal from an order of the Civil Court of the City of New York, Kings County, entered July 19, 2012, is modified to provide that only the duplicate notice of appeal filed September 7, 2012 is withdrawn, and the appeal taken by notice of appeal filed August 17, 2012 is reinstated; and it is further,
ORDERED that respondent shall have 14 days from the date of this decision and order on motion to serve and file a respondent's brief; and it is further,
ORDERED that appellant, if it be so advised, may serve and file a reply brief within seven days of the date that the respondent's brief is due to be filed pursuant to this decision and order on motion.
